Matson Piling Pty Ltd General Conditions

 

 

1.     Commencement is subject to availability of equipment and personnel.

2.     Daily rates of machine are assumed as being used for a maximum of 10 hrs per shift, including breaks. No reduction in rate applies for any delays including but not limited to wet weather unless prior agreement made in writing. Rate is for time out on hire not time used, excludes regular RDO's.

3.     All services including but not limited to storm water lines, sewer lines, water mains, electricity cables and Telecom Cables are to be accurately located and marked by others prior to establishment on site otherwise damage to any property whilst on site or accessing site shall be the responsibility of others.

4.     We have not allowed for:

(a) Setting out or providing levels;

(b) Removal of bored spoil;

(c) Any special site allowance;

(d) Providing site huts or ablution facilities.

5.     Piling Pad Certification.

Access and dry level earth working platforms are to be provided for plant and equipment.
The Client is responsible for the design, construction, certification, and ongoing maintenance of the piling pad (working platform) in accordance with AS 2159—2009 Piling—Design and Installation, relevant WHS Regulations, and industry best practice.

Certification Requirement.
Prior to commencement of drilling or piling works, the Client must provide a signed Working Platform Certificate confirming that the platform is suitable for the safe operation of piling rigs and associated equipment.

Maintenance Obligation
The Client must ensure the platform remains compliant throughout the project, including after adverse weather or site changes. Any deterioration or damage must be rectified before piling operations resume.

Onus of Responsibility
The Client acknowledges that failure to provide and maintain a certified working platform may result in delays, additional costs, or refusal to commence works. All associated risks and liabilities remain with the Client.

6.     Terms of Payment: The work will be invoiced monthly and/or on completion of the piling/contract. These invoices are to be paid in full within 30 days of invoice date. Additional charges may apply.

7.     Extra work, delays, obstructions: Should we be required to carry out extra work, be delayed by others, or encounter obstructions requiring removal or delaying our progress, we would charge you for the time involved. (Quote based on continuity of work.) The Client must provide Matson Piling with uninterrupted access to the site for the duration of the works. Unless otherwise agreed in writing, the Matson Piling requires a minimum of 10 hours per day of continuous access. Any interruptions to piling, including but not limited to wet weather, surveying, geotechnical investigations, toolbox talks, pad preparation or other site activities or delays in deliveries, will be deemed a delay. Delays caused by such interruptions will incur standby charges at Matson Piling Pty Ltd prevailing rates, in addition to any costs associated with rescheduling or extended project duration.

8.     Site Conditions: We require that the following clause form part of the Contract in the event that we are engaged to carry out the works: “Should any difference between the physical conditions and characteristics of the site, including sub-surface conditions be encountered during the execution of the contract works other than those shown, described or measured in the tender documents or contract agreement, involve Matson Piling Pty Ltd in any additional costs (adjustment for which is not otherwise provided for) then such amount shall be valued as a variation and added on to the Contract Sum.”

9.     Retention Monies: NIL

10.   The prices quoted are based upon the Conditions detailed.  Should you wish to amend any of the above conditions and/or enter into any special contract or sub-contract agreements with conditions differing from those detailed, then they must be agreed in writing prior to commencement of our work on site. AS2545-1993 is excluded from any agreement. For any changes to any of the conditions we reserve the right to amend our tender prices.

11.   We have Public Liability Insurance but if you require us to cover contract works and any other cover required by Principal it will be an extra onto quote. Variation shall be Invoice cost + 20% handling charge.

12.   Valid 90 days.

13.   Any increases in steel costs due to fluctuations will be passed on.

14.   Remove surface boulders etc before levelling surface.

15.   Design is not our responsibility.

16.   Quote is based on conditions stated. Acceptance of Quote shall indicate your acceptance that these conditions shall form part of any Sub-Contract Agreement and in the event of any discrepancy shall prevail over Sub-Contract Agreement.

17.   Any government requirements and charges e.g. environmental licenses, Q Leave, Notifiable Project are not our responsibility.

18.   Standby is and only to be charged for delays not caused by Matson Piling for periods equal to or greater than 30 minutes and only charged if production for day is down from allowed rate due to these delays. If a standby event occurs that is greater than 30 minutes the full period of delay will be charges in full.

19.   Stand down is for any whole day not worked due to delays not caused by Matson Piling including but not limited to wet weather, lack of steel / concrete, Principal or Client cease work orders / hold points, industrial disputes, lack of survey and or Geotech supervision. If no notice given day prior to intended stand down day, then stand by rates are incurred instead.

20.   Accommodation if not provided by others at reasonable level of comfort (ie min 3.5 star motel room per person or ensuited single man camp quarters per person), will be provided by Matson Piling at a rate of $300.00 per night per person.

21.   Client Management systems such as and not limited to Safety, Quality, Environmental will be adhered to by Matson Piling in place of our own systems if required.

22.   If not stated in drawings or specifications provided to Matson Piling prior to date of quotation, tolerances are as follows, +- 75mm in any direction and 20mm over 1000mm verticality.

23.   Weekly rate is for work between and including Monday to Friday of a normal working week and no pro rata rate applies for part weeks. Weekend work should be negotiated and can be charged as a case-by-case basis. Normal workday is for a maximum of 10hrs on site including two 30min breaks.

24.   Access for Mobilisation/ Demobilisation is assumed as fit to drive a low loader to the pile locations to unload the rig. Walking/ Tramming of these machines is very slow and if required for long distances (>500m or greater) time taken will be charged as stand by rate.

25.   Low strength rock is defined as having a point load strength of between Iso50=0.1-0.3Mpa and is further defined as Easily scored with a knife; indentations 1mm to 3mm show in the specimen with firm blows of the pick point; has dull sound under hammer. A piece of core 150mm long 50mm diameter may be broken by hand. Sharp edges of core may be friable and break during handling”. Any rock, unless otherwise noted and allowed for, that exceeds this definition will be charged as a variation.

26.   Rock that is Iso50 = 1.0Mpa is defined as “Readily scored with a knife; a piece of core 150mm long by 50mm diameter can be broken by hand with difficulty.” (excerpt from Douglas & Partners DESCRIPTION AND CLASSIFICATION OF ROCKS FOR ENGINEERING PURPOSES). This definition is further defined as being no more than “Medium Strength Rock” with a Unconfined Compressive Strength of between 6 – 20MPa (equivalent to concrete strength of 6 – 20MPa)

This figure is used to define ease of drilling before rock is encountered.

27.   Rock that is Iso50 equal to or greater than 3.0Mpa cannot be readily excavated via normal means. Production rates will be diminished. Rock that cannot be reasonably excavated at a rate of 300mm/ 30mins at 600mm diameter auger using a SR30 or equivalent machine shall be defined as HS rock. Defined as being a piece of rock 150mm x 50mm that cannot be broken reasonably by hand but can be broken with a single hit of a hammer.

28.   Unless otherwise noted, testing of piles (PIT, Sonic Logging, Static or Dynamic) has not been included in price.

29.   All piles are to be drilled prior to any excavation of trenches, pile caps or any such footing unless previously agreed.

30.   Reclean of piles is an additional charge of $500.00 per event/clean out.
